This last Wednesday, the Peruvian congress voted in favor of two separate international arrangements (“Strasbourg arrangement” and “Vienna arrangement”) that favor the patent and figurative elements of trademarks.
The industrial property in Perú has some good news to begin 2022 since, this last Wednesday 12, Peruvian Congress approved 2 international agreements that aim to “optimize all of the services that are offered to the users of the patents and industrial designs system of Peru”, declared Ernesto Bustamante (Fuerza Popular), who supported both arrangements.
The first arrangement, known as “Strasbourg arrangement” or “IPC arrangement”, was created on March, 24, 1971, and established the International Patent Classification (IPC), which is indispensable in recovering documents regarding patents during the “state of the art” search.
Furthermore, the States adopt a common classification for invention patents through this arrangement.
Bustamante also assures that this arrangement will allow to have a more active participation during “Assembly and Committee of Experts” meetings while also bringing to light recommendations and bodies of work from other specialized groups.
Likewise, it hopes to improve the management of applications for patents and industrial designs submitted to the Directorate of Inventions and New Technologies of Indecopi.
The second agreement, the “Vienna Agreement”, adopted in Vienna on June 12, 1973, establishes an International Classification of the Figurative Elements of Trademarks.
This means that it seeks a special union made up of the States to which they apply, which, in turn, adopt a common classification for the figurative elements of trademarks.
These agreements would facilitate certain legal concepts such as, for example, the “state of the art”, which refers to how many patents or innovations exist worldwide on a particular subject.
